Catherine Matheson [*] NAVAJO FAMILIES WHO HAVE CHILDREN WITH DISABILITIES In the United States, many have come to believe that families and family involvement are the most important factors in supporting children with disabilities. Families exist within an ecocultural environment that is complex and powerful, and it is within the family context that development in all its forms begins and is nurtured. We cannot understand what family involvement means without understanding the culture of families and the informal systems that families use to adapt and operate. In this chapter, the example of Navajo families with children with disabilities underscores and shows in high relief the heavy reliance on cultural support for families that is part of any family system. As early-intervention and family support programs continue to grow in the United States, we need to understand and sustain those benefits of indigenous systems that provide support and relief to families even as we seek to engage families in the use of supports that may be offered by private and public agencies. Two complementary systems operate to fulfill the needs of Navajo and other American families who have children with disabilities: one is the indigenous adaptive system and the other is the public health system that has been established nationally in the United States with local options. One example is the Individuals with Disabilities Education Act (IDEA 1997), parts B and C, providing early intervention, preschool, and school-age services. The indigenous system was in existence long before the IDEA, but has not been recognized as such. Both systems attempt to increase the well-being of families, but because all adaptive systems have a cost, neither system is totally benign. Each system extracts some payment for the benefits it provides. When discussing costs, our intent is not so much to point out financial costs, which are often involved, but to show that costs to families can be more subtle, such as the erosion of family responsibility and satisfaction with the efforts the family makes on behalf of the child with a disability. Thus, in the Navajo sample, families identified medical disabilities and sought help for medical problems from professionals but were sometimes unable to resolve their anxiety until they involved spiritual services or indigenous healing practices. Conversely, Navajo families did not identify learning disorders in the preschool age group that we interviewed. Learning and language disabilities were primarily identified by professionals and schools, who in turn sometimes found families apprehensive and reluctant to adopt an active role in early-intervention efforts that they had not sought themselves.

ORLANDO — Hospital teaching staff was more likely to adhere to American College of Obstetricians and Gynecologists guidelines for scheduling cesarean deliveries than were physicians in private practice, according to a retrospective chart review, Dr. M. Ryan Laye said at the annual meeting of the South Atlantic Association of Obstetricians and Gynecologists. However, this nonadherence did not result in an increase in adverse neonatal outcomes, said Dr. Laye, who was at Greenville (S.C.) Memorial Hospital when the study was conducted. Of the 296 patients being delivered by scheduled cesarean section for elective indications at the hospital, 222 (75%) were delivered in accordance with the American College of Obstetricians and Gynecologists recommendations for timing of elective delivery. Of those not adhering, 95.5% were private service patients, and 4.5% were teaching service patients. The admission rate for the neonatal intensive care unit in both groups was 3.7%, which is consistent with the rates for all cesarean deliveries, as reported in the neonatal literature, Dr. Laye said.

The NBERs Law and Economics Program studies the effects and causes of legal rules, with a special focus on the foundational legal subjects–property law, criminal law, contract law, and tort law–and on the operation of the legal process. In regard to the operation of the legal process, the Program examines topics such as labor markets for lawyers, litigation dynamics, judicial and agency behavior, and the determinants of legislative action. In addition, the Program studies the effects and causes of legal rules across a range of legal subjects beyond property, criminal, contract, and tort law, including corporate law, employment law, health care law, social welfare law, family law, bankruptcy law, patent and copyright law, and antitrust law. The Program meets twice per year, once at a mid-year program meeting and again at the NBERS Summer Institute. The Programs recent special activities include a project in the area of corporate governance, under the direction of Research Associate Lucian Bebchuk; selected papers from that project are scheduled to appear in a forthcoming issue of the Review of Financial Studies. In this article, I first describe recent research in the foundational legal subjects and then turn to work on the operation of the legal process. I conclude with an overview of work on the effects and causes of legal rules in corporate law, employment law, health care law, social welfare law, family law, bankruptcy law, patent and copyright law, and antitrust law. Property Law, Criminal Law, Contract Law, and Tort Law A fundamental aspect of any legal system is the structure of property rights. Recent work by Oliver Hart (13540) is the latest in an important line of papers by Hart, Sanford Grossman, and John Moore that examine the effects of a particular conception of property rights emphasizing “residual control.” In this view, the owner of an asset retains those rights to the asset that are not specifically assigned by any existing contractual commitment. While previous papers in the series have examined the effects of the residual control rights conception of property rights in the face of parties non-contractible up-front investments, the recent paper by Hart studies the effects of property rights of this form in a model with uncertainty of values and costs of a good to be traded. Harts model suggests that ex-ante contracting over asset ownership can reduce later incentives to engage in hold-up. A system that did not provide for property rights in the Grossman-Hart-Moore sense (reserving residual rights to the state rather than to the property owner) would be inferior within this framework.

1 Friday The blister beetle, Lytta vesicatoria, sometimes called the Spanish fly or the oil beetle, is a winged, bright green insect common to the USA, Canada, Europe, and southern Russia. The blister beetle is both a blessing and a curse to farmers. In the larval stage, blister beetles are welcomed by farmers, because they eat grasshopper eggs, which are notoriously destructive to crops. As adults, however, blister beetles develop a ravenous appetite for many of the same crops they once helped to protect from the grasshoppers.
American Burying Beetle (Nicrophorus americanus) The largest American burying beetle reintroduction effort in the 12-year history of the species recovery program took place recently on Nantucket Island off the Massachusetts coast. The Roger Williams Park Zoo in Providence, Rhode Island, raised well over 300 of the endangered beetles for release on Nantucket Island, a historic locality for the species. On June 11 and 12,320 American burying beetles (160 pairs) were given dead quail for food (the beetles require carrion to reproduce) and released at the Massachusetts Audubon Societys Sesachacha Wildlife Sanctuary. With each pair of beetles capable of raising 10-20 larvae, the 2001 release may result in thousands of beetles on the island by late fall. This effort is probably one of the largest reintroductions ever undertaken for an endangered insect species. Present to document the work was a film crew from the TV program, Wild Moments, and the Providence Journal newspaper. Partners in the work include the Rhode Island Division of Fisheries and Wildlife, Massachusetts Division of Fisheries and Wildlife, Roger Williams Park Zoo, Massachusetts Audubon Society, University of Massachusetts Boston Field Station, University of Rhode Island, Maria Mitchell Natural History Museum, and Nantucket Conservation Foundation. Indiana Bat (Myotis sodalis) As a result of a multi-agency partnership, endangered Indiana bats have been documented to migrate to the Lake Champlain Valley in Vermont from a hibernaculure in New York. Biologists tagged five Indiana bats (four females and one male) with radio transmitters as the bats left their hibernaculum (hibernation site) in early May. Three females were located by air and subsequently by land in Vermont within one to six days after release. Multiple roost trees for two of the females were identified; most of the roost trees were shagbark hickories. Evening counts of bats leaving the roosts ranged from 4 to 120 bats (probably more than one species roosted together). All of the Indiana bats were found on private land and all landowners granted permission for field staff to locate the bats. The success of this study was due to a substantial cooperative effort by state and federal agencies and concerned citizens. Staff and equipment were provided by our New England and New York Field Offices, the New York State Department of Environmental Conservation (which also provided the airplane and pilot), the Green and White Mountain national forests, and the Vermont Agency of Natural Resources. The West Virginia Department of Natural Resources loaned additional equipment. High school and college students also volunteered their time.
